Terms of Service

In short: kilde is free, open-source software provided under the MIT License, with no warranty of any kind. You are responsible for how you use it — in particular, for recording only what you are legally entitled to record.

1. Agreement

These terms apply to the website at kilde.site and to the kilde software — the command-line tool and the menu bar application — distributed by the kilde project. By using the site or the software, you agree to them. If you do not agree, please do not use them.

In these terms, "we", "us" and "the project" mean the kilde project and its maintainers, and "you" means the person using the site or the software.

2. The software and its license

kilde is open-source software released under the MIT License. Your rights to use, copy, modify and redistribute the software are granted by that license, and in any conflict between these terms and the MIT License, the MIT License governs the software itself. These terms cover this website and the conditions under which the project makes the software available.

The project is split across repositories. The menu bar application, release tooling, Homebrew formula and documentation are public; the recording engine and CLI source are maintained in a private repository, so public source builds are not available at this time. Nothing in these terms obliges the project to publish any particular source, release or version.

kilde records screens, system audio and microphones. Whether a given recording is lawful depends on where you are, who else is present, and what is being recorded — and it is entirely your responsibility to determine that before you press record.

Depending on your jurisdiction, this may include:

kilde provides the capability; it does not and cannot verify that you are entitled to use it in a particular situation. If you are unsure, seek your own legal advice.

5. Your recordings

Files you create with kilde are yours. The project claims no ownership of them, receives no copy of them, and has no access to them — they are written directly to your own machine, as described in the Privacy Policy. Storing, backing up, protecting and deleting them is up to you.

6. Availability and changes

This website and the project's releases are offered as they are, when they are. We may change, suspend or discontinue the site, any release channel, the Homebrew tap, or any feature of the software at any time, with or without notice, and we may update these terms. The current version is always published at this address with the date at the top updated. Continuing to use the site or the software after a change means you accept the updated terms.

7. Third-party services and software

kilde relies on Apple's macOS APIs, is distributed through GitHub and Homebrew, and can work alongside third-party audio drivers such as BlackHole and meeting applications such as Zoom, Google Meet and Microsoft Teams. Those products are operated by their own providers under their own terms and privacy policies. We do not control them and are not responsible for them. Links from this site to other sites are provided for convenience and are not an endorsement.

8. No warranty

The software and this website are provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement, as set out in the MIT License.

In particular, and although kilde is designed to finalize the output file safely even when a recording is interrupted, we do not warrant that a recording will start, complete, or produce a usable file in every circumstance. Do not rely on kilde as the sole record of something you cannot afford to lose without testing it in your own setup first.

9. Limitation of liability

To the fullest extent permitted by applicable law, the authors and copyright holders shall not be liable for any claim, damages or other liability — whether in an action of contract, tort or otherwise — arising from, out of or in connection with the software or its use, including lost, corrupted or unusable recordings, lost data, lost profits, or business interruption.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, such as liability arising from intentional misconduct or gross negligence. If you are a consumer, you may have rights under mandatory law that these terms do not affect.

"kilde" and the kilde mark identify this project. Apple, Mac and macOS are trademarks of Apple Inc.; GitHub is a trademark of GitHub, Inc.; Zoom, Google Meet and Microsoft Teams are trademarks of their respective owners. They are referred to here for identification only, and those references do not imply any affiliation with or endorsement by their owners.

11. Governing law

These terms are governed by the laws of Japan. Any dispute arising from them or from the use of the software or this website shall be submitted to the exclusive jurisdiction of the Tokyo District Court as the court of first instance, without prejudice to any mandatory rights a consumer may have to bring proceedings in their own place of residence.
